1. Who we are

This website at https://www.betterbusinessfoundry.com (Site) is operated by Intifica Pty Ltd ABN 14639590079 trading as Better Business Foundry (we, us, our).

By using the Site or buying any of our products or services, you agree to these Terms and Service (Terms). If you do not agree, do not use the Site or purchase from us.

2. What we sell and who we sell to

We sell digital products and related materials, including the Systems Over Superheroes Implementation Kit and other business operating system tools (Products), and may provide related advisory or implementation services (Services).

Our Products and Services are designed primarily for business owners and managers. Where you acquire our Products or Services as a consumer under the Australian Consumer Law (ACL) or other applicable consumer laws, nothing in these Terms excludes, restricts or modifies your non excludable statutory rights.

3. Orders, payment and delivery

Prices are shown in Australian dollars (AUD) unless stated otherwise. We can change prices at any time before you place an order.

When you place an order, you offer to buy the relevant Product or Service under these Terms. We may accept or reject any order. An order is accepted when we send a confirmation or provide access.

Payment is processed via our chosen payment provider. You authorise us and our provider to charge your selected payment method for the total amount.

Our Products are digital. Delivery is complete when we email access details, download links or log in details to the email address you provide, or otherwise make access available. You are responsible for having suitable hardware, software and internet access.

4. Licence and intellectual property

All intellectual property in the Site, Products and Services is owned by or licensed to Intifica Pty Ltd.

When you buy a Product and pay all fees, we grant you a non exclusive, non transferable licence to use that Product for your internal business purposes only, subject to these Terms.

You must not, without our prior written consent:

  • share, sell, resell, distribute, publish or sub license any Product to third parties

  • upload or share Products in public or client facing libraries

  • remove any copyright, trademark or attribution notices

  • create derivative products that compete directly with our Products.

If you have team access or a multi user licence, your team members may use the Product inside your business, but you remain responsible for their compliance with these Terms.

5. General information only and no professional advice

The Site, Products and Services provide general information, frameworks and tools to help you design and improve your business operating system. They:

  • do not consider your specific circumstances

  • are not financial, legal, tax, accounting, HR, medical or other professional advice.

You are responsible for:

  • assessing whether our Products are suitable for your situation

  • obtaining independent professional advice where needed

  • any decisions you make and actions you take based on our materials.

6. No guarantees of results

With the exception of the 90-Day BOS Implementation Kit Guarantee below, we make no guarantee that using the Site, Products or Services will produce any particular outcome, including:

  • higher revenue or profit

  • cost savings

  • specific operational improvements

  • business valuation changes.

Any examples, case studies or testimonials are illustrative only and are not a promise of what you will achieve.

7. 90-Day BOS Implementation Kit Guarantee

This section applies only to the Systems Over Superheroes 90-Day BOS Implementation Kit and is in addition to any non excludable rights you have under the ACL or other laws.

7.1 Overview

If you:

  • purchase the 90-Day BOS Implementation Kit (the "Kit")

  • follow the Companion: Implementation Guide in good faith

  • and still do not feel that the Kit has delivered meaningful value to your business

you may request a full refund of the Kit purchase price within 120 days of the original purchase date, subject to the conditions below.

7.2 Eligibility

To qualify, you must:

  • have purchased the Kit directly from https://www.betterbusinessfoundry.com 

  • submit your refund request within 120 calendar days of your original purchase date

  • have followed the Companion: Implementation Guide

  • provide reasonable evidence of your implementation effort, such as copies of BOS artefacts created aligned with the Companion: Implementation Guide.

We do not require proof of a particular financial result. We do require evidence that you have used the Kit as intended.

7.3 What we refund

If you meet the conditions and still feel the Kit has not delivered sufficient value, we will refund 100 percent of the amount you paid for the Kit to your original payment method where possible, or otherwise by an alternative method we reasonably agree with you.

The guarantee:

  • covers only the Kit purchase price

  • does not cover your time, wages, contractors, advertising spend, software subscriptions or similar third party costs

  • does not apply to separate advisory or consulting Services unless we state this in a separate written agreement.

7.4 How to claim

To request a refund under this guarantee, email info@betterbusinessfoundry.com with the subject line "90-Day BOS Implementation Kit Guarantee Request" and include:

  • your full name

  • the email used for purchase

  • your order number and purchase date

  • a short explanation of why you feel the Kit has not delivered sufficient value

  • the evidence described in section 7.2.

We will review your request and reply within a reasonable time. We may ask for further reasonable information to assess eligibility.

7.5 Misuse

We may decline a guarantee claim if there is clear evidence of fraud, abuse, or no genuine implementation effort. This does not limit any non excludable statutory rights you may have.

8. Refunds outside the guarantee

Because our Products are digital and access is granted immediately, we do not generally offer refunds for change of mind or accidental purchase, except:

  • where required by the ACL or other applicable laws, or

  • where you qualify under the 90-Day BOS Implementation Kit Guarantee.

9. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantees or other rights you may have under the ACL or other laws that cannot be excluded.

Where it is lawful to do so, and for non excludable guarantees or obligations where liability can be limited, our liability is limited to:

  • for goods: replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so

  • for services: resupplying the services or paying the cost of resupplying them.

To the maximum extent permitted by law, we are not liable for:

  • loss of profit, revenue, business, goodwill or anticipated savings

  • loss of opportunity

  • loss or corruption of data

  • business interruption

  • indirect, special or consequential loss or damage

arising in connection with your use of the Site, Products or Services, or these Terms, whether in contract, tort, equity, statute or otherwise.

You acknowledge that business outcomes depend on many factors outside our control, including your leadership, team capability, financial resources, market conditions and execution. You use our Products and Services at your own risk.

10. Indemnity

To the maximum extent permitted by law, you indemnify us and our directors, officers, employees and contractors against any loss, liability, damage, cost or expense (including reasonable legal costs) arising from:

  • your breach of these Terms

  • your misuse of the Site, Products or Services

  • any claim by a third party that relates to your use or implementation of our Products or Services in your business,

except to the extent caused by our negligence or wrongful act.

11. Privacy

All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here [LINK], and certain personal information may be subject to Shopify’s Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. 12. Governing law

These Terms are governed by the laws of Western Australia, Australia. You submit to the exclusive jurisdiction of the courts of Western Australia and the Federal Court of Australia (Perth registry) and any courts that may hear appeals from those courts.
